The Movement of Entrepreneurs and Businessmen - Liberal Democratic Party of Uzbekistan has responded to instances of forced dismantling of outdoor advertising media and other lightweight structural objects belonging to entrepreneurs.
In recent years in Uzbekistan, protecting the rights of entrepreneurs and developing business has been designated as one of the top priorities of state policy.
However, despite the ongoing reforms, cases of unjustified interference in entrepreneurial activity and violation of the inviolability of private property by state organizations continue to be observed.
In particular, in recent days, cases of forced dismantling of outdoor advertising media, electric vehicle charging stations, and other lightweight structural objects belonging to entrepreneurs in the city of Tashkent and a number of regions have caused widespread discussions.
According to Article 65 of the Constitution of the Republic of Uzbekistan, the inviolability of private property is guaranteed, and a property owner cannot be deprived of their property except in cases and procedures provided by law and without a court decision.
The fact that entrepreneurs obtained permits in the manner established by legislation during the establishment of their activities and installation of relevant objects cannot serve as a basis for later declaring them “illegal” or “non-compliant with the design code” and demolishing them without a court decision.
According to legislative acts, strict liability is established for unjustified interference in the activities of business entities and violation of private property rights. Any controversial situation, including the issue of objects recognized as “illegal structures”, must be considered exclusively in the legal field – through judicial procedure.
In this regard, the Liberal Democratic Party of Uzbekistan considers it necessary to ensure the rights and legitimate interests of entrepreneurs and deems it appropriate to take the following measures:
– putting an end to the practice of forced dismantling of business entities' property without a court decision;
– decisions and actions of state bodies should not cause damage to entrepreneurs, but rather serve to protect their legitimate interests.
Representing the interests of its electorate regarding this situation, members of the faction in the Legislative Chamber will send parliamentary inquiries to relevant state organizations demanding an explanation regarding the legality of their actions.
We state that the issue of guarantees of business activity freedom and the protection of property rights remains under the constant supervision of the Liberal Democratic Party of Uzbekistan.
