In the khokim's decree — 13 sotix, in the cadastral document — also 13 sotix. But why is a part of the land, for which the heir has been paying taxes for years, not under their possession today? Effect.uz is investigating the documents, disputed construction, and activities of responsible agencies behind a family's unresolved land dispute in Hazorasp.
A situation related to a family's land plot in the Sanoat makhalla of Hazorasp district, Khorezm region, raises a number of questions. According to existing documents, by the decision of the khokim of Hazorasp district in 2017, rights regarding the residential house and land plot belonging to the late Nasurullo Ibodullayev were formalized.
According to the decree, the decision of the interdistrict court for civil cases of Bogot on September 8, 2016, No. 4213 was accepted for execution, and the right of lifelong inheritable possession of a 0.13-hectare land plot was established.

Subsequently, in the formalized cadastral documents, the land area was also recorded as 0.130 hectares, i.e., 13 sotix.
However, the late owner's heir states that today they cannot fully use the land area indicated in the document. According to their claim, part of the land is related to construction in the neighboring area.
After Effect.uz staff began investigating the situation, specialists from the State Cadastre Chamber also went out to the site and conducted measurements. In the diagram provided to the editorial office, 1117.2 sq.m is allocated as “residential land”, and another 284.6 sq.m as “front yard”. However, the legal status of this 284.6 sq.m area and how it relates to the 1300 sq.m land formalized in 2017 need to be clarified.

Another circumstance complicates the matter. According to the heir, the family has been paying taxes for years on the 13 sotix land area recorded in the documents. This information needs to be verified against the official calculations of the tax authority.
At this point, the main question arises: if the state recognized the citizen's right to 13 sotix of land, registered it in the cadastre, and calculated taxes based on this area, where do the exact boundaries of this 1300 square meter land run today?
Another important issue is the location of the old building belonging to the neighbor. The heir claims that this construction may have encroached upon a part of the land formalized for their father. However, to firmly confirm this claim, it is necessary to compare the cadastral coordinates of 2017 with today's geodesic measurements.
It is also noteworthy that the khokim's decree assigned relevant tasks to the makhalla citizens' assembly, the architecture and construction department, the cadastre service, and officials supervising the execution of the decree.
Therefore, during the investigation, Effect.uz seeks answers to a number of questions from the responsible agencies:
Where are the current coordinates of the 13 sotix of land recognized by the state in 2017? Does the building belonging to the neighbor fall within these boundaries? If taxes were calculated for 13 sotix, has the citizen actually been able to use all parts of this land? And most importantly — was the khokim's 2017 decree fully executed?

Regarding these questions, the editorial office will study the official responses of the Hazorasp district khokimiyat, cadastre, architecture and construction, tax authorities, and other responsible agencies. The position of the opposing party will also be heard.
