Many people in the Nishan district of Kashkadarya know the Bobur farm and its head, Bahodir Koldoshev. Especially mayors, prosecutors, and judges.
He is a regular farmer like anyone else. He hasn't made any world-shattering inventions. But for eight years, he has been searching for one thing — justice.
Bahodir Koldoshev has been wandering from court to court since 2019 to return the land plots that he believes were unlawfully seized from him.
His "fame" lies precisely in this — he did not hold back. And, perhaps, he does not intend to hold back either. Until justice is established.
Born and Strangled at Once. The Beginning of the Wandering
Bahodir Koldoshev started his farming activities in 1998. At that time, he organized the Bobur farm on a 36-hectare land plot consisting of 86 contours, later changed to 54 contours.
In 2019, following the land plot optimization process, the farm's land area reached nearly 106 hectares.
Interestingly, just four months after signing the allocation of these 106 hectares on January 23, 2019, Nishan district mayor Mukhtar Khaytmurodov made a decision on May 24 to return these lands to the district reserve.
Thus, the farmer's land plot was once again removed from his possession.
On what basis was the land taken away from the farmer? Why does he consider this decision illegal?
These questions would later find their reflection in the courts as well.
In June 2019, part of these lands was allocated to other legal entities. In particular, a 36-hectare land plot was allocated to Nishan Chicken's LLC PE.
Dissatisfied with these decisions, Bahodir Koldoshev applied to the court.
By the decision of the Nishan District Administrative Court dated November 20, 2019, the district mayor's decisions to return 105 hectares of land belonging to the farmer to the reserve and to allocate these lands to two other legal entities were found invalid.
The Nishan District Hokimiyat appealed against this decision.
However, on February 13, 2020, the cassation instance court of the Kashkadarya Regional Administrative Court left the decision unchanged.
Thus, the hokimiyat decisions regarding the return of the farmer's lands to the reserve and their subsequent allocation to other subjects had been found invalid in the courts.
The Nishan District Hokimiyat did not appeal to the Supreme Court.
Consequently, the farmer's right to 106 hectares of land should have been restored in practice.
But events take an even more interesting turn from here.
There Was a Court Decision. But 36 Hectares Were Given to Nishan Chicken's Again
On March 20, 2020, that is, after the previous decisions regarding the return of the farmer's lands to the reserve and their allocation to other legal entities were found invalid by court decisions, Mayor Mukhtar Khaytmurodov makes another decision.
By this decision, the 36-hectare land plot belonging to the Bobur farm is once again allocated to Nishan Chicken's LLC PE.
What is noteworthy here is that, according to the documents provided by the farmer, this land plot belonged to the Bobur farm at that time.
Because the mayor's decision of May 24, 2019, on taking the land into the reserve was found invalid by the courts.
Therefore, the question arises:
While the situation based on the decision found invalid by the courts has not been eliminated, on what legal basis was that same land plot allocated to another enterprise again?
In answering this question, first of all, the land legislation in force at that time and the legal bases of the hokimiyat decisions must be studied.
Who Is Behind Nishan Chicken's?
The farmer's claim is not limited only to the non-return of the 36 hectares of land.
He is also expressing suspicions that there may be a conflict of interest surrounding the allocation of land to Nishan Chicken's LLC PE and the activities of this enterprise.
According to the farmer, the land was given to the enterprise on the condition of developing poultry farming and making investments.
Therefore, another question arises here:
Did the enterprise fulfill these obligations? Were the promised investments for the development of poultry farming made? Is the allocated land plot being used purposefully and efficiently?
During our observations, we saw that alfalfa and other crops are being grown on these land plots.
According to the farmer, alfalfa is grown on about 22 hectares of the land plot, and other crops are grown on around 13 hectares.
For this reason, the following questions remain open:
What was the main purpose of the allocated land? Is the enterprise currently carrying out the activities indicated in its charter? Have the investment obligations been fulfilled?
The enterprise itself and the relevant responsible organizations can clarify these questions.
What Are the Claims Related to the Prosecutor's Office?
The most serious part of the article begins here.
According to the farmer's claim, the fact that a relative of a person who worked in the prosecutor's system and still works in the regional prosecutor's office is behind Nishan Chicken's LLC PE may be the reason why his land issue has not been resolved for years.
We are talking about Abdimurodov Temurbek Abdimurodovich, the nephew of Sherniyoz Umrzakov, who worked as the prosecutor of the Nishan district in 2022–2024.
According to the information provided by the farmer, Abdimurodov Temurbek Abdimurodovich held a 33 percent stake among the founders of Nishan Chicken's LLC PE.
It is reported that there are also two Afghan citizens among the founders of the enterprise.
However, an important point: this information alone does not prove that the prosecutor's employee or his relative illegally interfered in the farmer's land issue. This is a suspicion and allegation put forward by the farmer.
For this reason, the most important question is another:
Has this conflict of interest situation been studied by the relevant authorities? If it was studied, what conclusion was reached?
For the public, precisely a clear and documented answer to this question is important.
«The Chicks Will Be Brought Now...»
During our research, we also tried to see the facilities of the enterprise related to poultry farming.
At the place we visited, we saw that there is a smaller chicken farm belonging to the old cotton-ginning enterprise. Family members of one of the founders of the enterprise, who is an Afghan citizen, were also met here.
We were told that the chicks would be brought now.
There is a saying among our people: «count your chickens in the autumn».
And here it seems the time to count the chicks has long arrived.
Because it has been several years since the land was allocated.
Therefore, numbers and documents should speak now:
How much investment was made? How many poultry are being raised? How much products are being produced? For what purpose is the land being used?
If all obligations have been fulfilled, it is not difficult to show this with documents.
The Eight-Year-Old Question
According to Bahodir Koldoshev, he has been applying to various agencies and courts to return his land since 2019.
The most interesting part is that some of his demands have also found their confirmation in the courts.
Even so, the issue of the 36 hectares of land remains open.
Imomyor aka, the farm's manager, expresses concern that this situation may affect not only the farmer himself, but also the country's reputation.
«There are Afghan citizens among the founders of these lands. Won't they go back to their homeland, tell their compatriots about such situations in our country, and laugh at us?» — he asks.
This, of course, is an emotional reaction.
But the essence of the matter lies elsewhere.
Why wasn't the legal status of the land fully resolved for years despite the existence of court decisions?
For what reason were new decisions adopted regarding this land plot even after the decisions found invalid in court?
Have the investment and poultry farming obligations set when allocating land to Nishan Chicken's been fulfilled?
Have the information that a close relative of a person who worked in the prosecutor's system was among the founders of the enterprise been checked by authorized agencies?
Most importantly:
When will the legal right of the farmer who has been going from court to court for eight years finally be restored?
We believe that the answers to these questions should be provided not by individuals, but by documents, court decisions, and the law.
EFFECT.UZ will continue to study the information presented in the farmer's appeal regarding this issue.
At the same time, we are ready to listen to the position of Nishan Chicken's LLC PE and the persons mentioned in this situation.
If the enterprise or responsible organizations answer the above questions, their response will also be given in full in the article.
