Effect.uz editorial office investigated a dispute related to real estate in Khorezm region based on an appeal received. According to the appealing party, Dildora Bekchanova, a resident of Khiva, purchased a residential property several years ago through a notarized sale and purchase agreement.
According to lawyers, it was later revealed that other cadastral documents related to this facility were falsified. Two individuals were held criminally liable for this case, and court verdicts recorded that the documents were forged.
Representatives of the appealing party noted that based on the documents recognized as forged, a multi-story building was registered with the state, formalized as collateral, and a credit of 4.3 billion soums was allocated against this property. They also believe that this situation may have affected the property rights of other citizens.
In this regard, the appellants attended the receptions of the Khorezm region prosecutor, asking to remove the cadastral documents recognized as forged by court verdicts from the state register, review the decisions made on their basis, and give a legal assessment of the credit allocation processes.

A representative of the cadastral authority stated that the issue was considered by a special commission. According to them, since the title documents and sale and purchase agreements have not actually been invalidated, there is no legal basis to remove the property from the state register.
A representative of Uzpromstroybank also emphasized that the documents submitted to the bank during the credit allocation process were legal. According to him, the prosecutor's office and other authorized bodies conducted an investigation into this situation, and no violations of the law were found in the credit allocation.
The bank representative also stated that if the legal status of the collateral property changes later, the bank will protect its interests in a legal manner and take measures to recover the damages caused from the guilty parties.
Currently, certain issues related to the dispute are being considered in court instances. The appellants state that they are waiting for a clear legal solution from the relevant authorities regarding the fact that documents recognized as forged by two court verdicts still remain in the state register.
