State land is being dug up in Fergana: who is responsible for public safety?

The pedestrian area has been dug up, and the walkway has been ruined. Now the simple question is: to whom and on what legal basis was this land allocated?

Excavation work being carried out in public areas near house 14-B, Shifokorlar street, Kirgili microdistrict, Mehrbonlik MFY in the city of Fergana is causing public outrage.

According to the appeal, as a result of the excavation work, the condition of the area has deteriorated, making it difficult for residents to move freely and safely, particularly in using the sidewalk.

However, it should be noted that the issue is not limited to landscaping or sidewalk problems.

The main question is — what is the legal status of this area?

If we are talking about state land for public use, on what legal basis is it being excavated? To whom was the right to use the land granted? Are there relevant permits and documents to carry out the excavation work?

It is also necessary to clarify how this area is registered in cadastral documents and whether there is an approved project based on urban planning and architectural requirements.

Even if the work is carried out on a legal basis, why the safe movement of residents and the necessary walkway for pedestrians were not provided remains a separate question.

To give a legal assessment of this situation, it is necessary to study the status of the land, the right to use it, permits issued for construction or excavation work, and existing project documentation.

In this regard, the prosecutor's office, cadastre, and organizations responsible for architecture and urban planning are asked to:

— study impartially the legal status of this area;

— to whom and on what basis the right to use the land was granted;

— whether permits for excavation work exist or not;

— the legality of the project and urban planning documents;

— whether public safety requirements were met or not

and provide clear information to the public.

The status of state or public-use land cannot be changed arbitrarily. Public safety must take precedence over any construction or economic interests.

Now the question goes to the responsible organizations:

For whose benefit is this area on Shifokorlar Street being excavated? Is there a legal basis for the land? Who is responsible for public safety?

EFFECT.UZ awaits an official response from the responsible organizations regarding this situation.
