Earlier, EFFECT.UZ published a journalistic investigation based on appeals from 1,700 citizens regarding problems related to the “CITY TOWER” construction project in Tashkent and “IQBOL ZAMIN SEVRIS” LLC.

Following this, Mirzo Ulugbek district hokim Bahodir Goibnazarov met with the citizens. During the meeting, the issues raised in the public appeals were examined with the participation of a relevant working group.

During the review, it was reported that a criminal case had been initiated against Sh. Qurbonov, the founder of “IQBOL ZAMIN SEVRIS” LLC, that this case had been placed under the control of the General Prosecutor's Office, and that an international search had been declared for him.

Why did the citizens go to court?

It was reported that Sh. Qurbonov's spouse, Qurbonova, managed the LLC's activities under a power of attorney. Later, a preventive measure in the form of detention was applied against her.

Qurbonova's lawyers filed an appeal against this decision.

After that, citizens who stated that they were victims of the “CITY TOWER” project went to the Tashkent City Court, where the appeal case was being reviewed.

According to the citizens, they were explained that the court session was closed and that only the parties to the case could participate in it.

However, the citizens stated that they had also suffered material and moral damage from this situation, and that some apartments had been pledged to the bank, asking for an opportunity to meet with the judge and address the issues of concern to them.

“The promises made were not kept. The judge should have met with us, but that did not happen. No matter what happens, we are strictly against changing the preventive measure applied to Qurbonova,” the citizens say.

Following this, a misunderstanding arose between the citizens and court staff inside the Tashkent City Court building. The situation escalated, creating conditions that could potentially lead to protests.

What decision did the court make?

The Tashkent City Court did not satisfy the appeal. As a result, the decision of the Yashnabad District Court for Criminal Cases to apply the preventive measure of detention against Qurbonova was left unchanged. However, another important aspect of the issue remains open: How will the problems related to the housing, financial interests, and rights of 1,700 citizens be resolved?

This is also the main demand of the citizens — a clear legal assessment of the fate of their funds and apartments, and the provision of a practical solution to the problem.

The Tashkent City Court clarified the situation further

Reacting to the reports circulated regarding the “CITY TOWER” case, the Tashkent City Court stated that the criminal case has not been reviewed on its merits in court .

According to the court, only the appeal against the preventive measure in the form of detention applied to an individual within the framework of the case of “IQBOL ZAMIN SEVRIS” LLC was reviewed in the Tashkent City Court.

It was also emphasized that issues related to procedural coercive measures are to be considered in a closed court session in accordance with the law, and that the judge cannot communicate with interested parties in a manner not provided for by procedural order. At the conclusion of the appeal, the preventive measure was left unchanged.

EFFECT.UZ will continue to monitor the proceedings on this case.
